1. Business Identity & GST

  • All commercial transactions are conducted under the trade name M/S SABA KARIM.

  • Registered wholesale and retail customers are responsible for providing accurate GST details at the time of order to claim Input Tax Credit (ITC).

2. Products and Quality

  • Natural Variance: As soil, compost, and manure are natural organic products, slight variations in color, texture, and moisture content may occur between batches.

  • Suitability: While we provide premium quality soil, it is the buyer's responsibility to ensure the specific soil type ordered is suitable for their specific crop or plant species.

3. Pricing and Payments

  • All prices are listed in Indian Rupees (INR).

  • Wholesale Pricing: Bulk pricing is subject to the minimum order quantities specified in our wholesale catalog.

  • Payment Terms: Orders must be paid in full before dispatch unless a prior credit arrangement has been established in writing for long-term wholesale partners.

4. Shipping and Bulk Delivery

  • Delivery Access: For bulk shipments (truckloads/tractors), the customer must ensure that the delivery site is accessible by heavy vehicles. If a delivery fails due to restricted access or narrow roads, the customer may be liable for re-delivery charges.

  • Unloading: Unless otherwise specified, the customer is responsible for providing labor or machinery for unloading bulk soil shipments at the destination.

  • Timeline: We strive to meet all delivery timelines; however, external factors like weather conditions (which affect soil moisture and weight) may occasionally cause delays.

5. Cancellations and Returns

  • Cancellations: Orders for bulk/loose soil cannot be cancelled once the material has been loaded onto the transport vehicle.

  • Returns: Due to the nature of the product and the high cost of logistics, we generally do not accept returns once the soil has been unloaded at the customer's site.

  • Damaged Goods: For bagged products (e.g., 5kg or 25kg bags), any damage must be reported with photographic evidence within 24 hours of delivery for a replacement or refund.

6. Limitation of Liability

M/S SABA KARIM shall not be held liable for any crop failure, plant death, or secondary losses resulting from the use of our products beyond the replacement value of the soil supplied. Our maximum liability is limited to the total invoice value of the order.

7. Governing Law

These terms are governed by the laws of India. Any disputes arising from transactions on this website shall be subject to the exclusive jurisdiction of the courts in Sundargarh, Odisha.

8. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Continued use of the website following any changes constitutes acceptance of the new terms.
